BLUEBOO EVENTS: BOOKINGS AND TERMS OF PARTICIPATION

In addition to the BlueBoo Website Terms of Use and Privacy Policy, which apply to the website at www.blueboo.co.uk (our Site) belonging to BlueBoo Media Limited, these terms and conditions (Terms of Participation) will apply if you book a place at or register for a BlueBoo Media Event (the Event).

If you intend to book for and attend an Event run by us, please read carefully the following Terms of Participation carefully before booking to attend or registering for the Event.

By booking to attend an Event, you agree to be bound by these terms and conditions.  If you have objections to the any of the following Terms of Participation, you should not register for or book a place to attend the Event.

However, these terms and conditions do not affect your statutory rights.

You should print a copy of these terms and conditions for future reference.

BOOKING TERMS

1.1 In these Terms of Participation, references to blueboo, we or us are to blueboo Media Limited and references to you are to a person booking a place on or registering for an Event.

1.2 Dates for upcoming Events and the location at which they are being held are set out on our Site.  If you wish to register to attend or book a place at an Event, you should complete a booking form or click the appropriate button on our Site to register/book a place and complete and submit the payment form for the fee.  By completing the relevant form or, if you are booking verbally or registering online, clicking the appropriate button and completing and submitting the relevant payment details, you are making an offer to register a place at and attend the Event, which if accepted by blueboo in accordance with these terms, will result in a binding contract for you to attend the Event (subject to provisions of paragraph 3.5).

1.3 A contract for your booking for an Event between you and us will be binding from when we confirm our acceptance of your booking by email.

1.4 Bookings are only made available on a ‘per individual’ (rather than a ‘per organisation’) basis.

1.5 Please note that the Events are only available business owners, sole traders and entrepreneurs in business.  It is not available to:

1.5.1 individuals who want to attend the Event in their personal capacity and not as part of a business; or

1.5.2 PR or marketing agencies, unless we have specifically approved this in advance.

1.6 To book to attend an Event you must be at least 18 years of age.

1.7 blueboo has the sole and absolute discretion in determining whether it will accept any registration or booking for an Event.

1.8 blueboo reserves the right to ask you at any time for confirmation and/or evidence in writing that you fall within the categories of eligible attendees for an Event as set out in paragraph 1.5 above.  Any breach of this condition can result in cancellation of place to attend the Event.

1.9 If you book a place at an Event in error you must inform support@blueblue.com within 24 hours of you completing and submitting the relevant booking form or payment form.

1.10 Where an organisation books a place for an Event for one attendee, it may if that attendee is unable to attend send a replacement attendee to fill the place provided that they satisfy the requirements set out in paragraph 1.5 above and we are notified at least 24 hours in advance of start of the Event.

1.11 In booking to register for and attend an Event you agree to us using and processing your personal information in accordance with our Privacy Policy for the purposes of the Event and any related services we may provide to you in connection with the Event.

PAYMENT

2.1 Your credit or debit card will be charged for the fee as set out in the booking form or payment form.  In some circumstances, we may, in our discretion, offer you the opportunity to pay the fee in instalments.  This will option will be stated in the relevant booking form or payment form where applicable.

2.2 If you so request we will send you an invoice in respect of the booking fee.

2.3 We reserve the right to claim interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 on overdue fees.

CANCELLATIONS AND CHANGES TO THE EVENT

3.1 If you have registered for or booked a place on an Event you have a right to cancel your booking within 7 days and we will refund to you any sums that you have already paid to us within 30 days of receiving notification of cancellation. If you do have a right to cancel and you wish to do this, you can contact us via email at support@blueboo.co.uk or via our help line number on 01564 771 510.  Due to the overheads associated with running an Event, if you cancel a booking more than 7 days after making the booking or registering for the Event and submitting your booking form or payment form, we are unable to refund to you any sums paid.  At our discretion, we may be able to agree that you will be able to attend another similar event run by us or send someone else to attend in your place but we are under no obligation to do this.

3.2 We reserve the right to cancel and/or amend the Event dates, times, details of the content and venue at any time before the Event is delivered by giving you at least 24 hours’ prior notice, where it is practical to do so.  In any event, we will make every effort to give you as much notice as possible and offer you reasonable alternatives.  Should we have to cancel an Event we do not accept responsibility for travel, accommodation or any other costs which have been incurred by attendees who had booked for the Event, we will either offer an alternative date or a service within blueboo to the same value.

3.3 We reserve the right to alter the content and speakers for our Events where necessary without giving you prior notice but we will use all endeavours to cover the subject matter and offer you an alternative solution to cover the value of the Event.

CONDUCT OF ATTENDEES

4.1 All attendees must be respectful and professional to our staff, location hosts, speakers and other attendees and guests throughout the Event.  This applies during formal session and also lunchtime and breaks.  We reserve the right to ask an attendee to leave the Event if we reasonably believe their conduct is unacceptable or if we believe the attendee is intoxicated or in possession of alcohol or any illegal substance.  In such circumstances we will not be obliged to reimburse the fee paid for attending the Event.

4.2 Attendees are expected to take part in all exercises and sessions and contribute to discussions and complete any feedback forms which we provide at the end of the Event so that we can improve and fine-tune any future events.

4.3 Except as otherwise expressly stated, all information made available or shared during an Event should be considered confidential and should not be shared outside the Event, without express consent of the person disclosing such information.

COURSE MATERIALS

5.1 Unless we agree otherwise in writing, we will retain ownership of the intellectual property rights in any of our materials, templates or resources that we provided to you as part of the Event but you will have the right to use them for the purpose for which they were provided in your own business.  You should not provide them to any other person or reproduce them or use them in another context, without our prior written permission.

5.2 The resources and information provided as part of the Event are to be treated as by you as proprietary to us and are not to be made publicly available or published by or on your behalf.

5.3 Any breach of this paragraph 5 can result in cancellation of your access to any services to which you are given access to in connection with the Event without further notice.

CONSENTS TO RECORDING, FILMING AND PHOTOGRAPHY

6.1 In agreeing to participate in the Event, you give your agreement to any audio or video recording and your inclusion in any photographs which are taken as part of the Event.

6.2 If you agree, we may use any such material on our Site as testimonials or to demonstrate the training which takes place at the Event.

DISCLAIMERS

7.1 We make the training and materials available to you as part of the Event in good faith to help you build your expertise and understanding of PR and what is required in dealing with and responding to media enquiries and opportunities.

7.2 You are solely responsible for any decision you make or action you take as a result of the training and materials made available as part of the Event and the outcome of any such action you take as a result of this.  We cannot accept any responsibility for any specific outcome arising from your use of the training and materials provided as part of the Event.

7.3 Any advice we give you as part of the Event on financial, legal, compliance or similar matters are of a general nature only and you should take advice from an appropriately qualified professional before taking any action on these matters.

LIMITATION OF LIABILITY

8.1 To the extent permitted by applicable law and subject to paragraph 8.3 below, we exclude all liability (whether arising in contract, tort, breach of statutory duty or otherwise) which we may otherwise have to you as a result of any error or inaccuracies in any materials or information provided to you during or after the Event or as a result of anything you do or do not do during or following your attendance at the Event.

8.2 We do not exclude or limit our liability for death or personal injury arising from our negligence, for any fraud or fraudulent misrepresentation made by us in relation to the Event or for any other statutory rights which are not capable of being excluded as a matter of law.

8.3 Subject to paragraph 8.2 and 8.4, our maximum aggregate liability under or in connection with the provision of Event whether such liability arises in contract, tort (including negligence) or otherwise, shall in no circumstances exceed one and a half times the total fee paid by you for booking to attend the Event.

8.4 Subject to paragraph 8.2, under no circumstances shall we be liable to you for any loss or damage suffered (including, without limitation, indirect, consequential or special loss or damage) arising from your use of the training, materials and/or information you receive as part of the Event.

8.5 Except as set out in these Participation Terms, any condition, warranty, representation or other term which might otherwise be implied or incorporated into these terms, whether by statute, common law or otherwise, are excluded to the extent that this is permitted by law.  However, nothing in these terms shall operate to prejudice any mandatory statutory requirement or any statutory right you may have.

GENERAL

9.1 If any of these terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining Participation Terms and will not affect the validity and enforceability of the remaining provisions.

9.2 In the event that we fail to exercise any right or remedy contained herein, this shall not be interpreted as a waiver of that right or remedy.

9.3 In the event of any conflict between these Participation Terms and any prior versions thereof, the provisions of these Participation Terms shall prevail unless it is expressly stated otherwise.

9.4 Nothing in these Participation Terms shall confer any rights upon any third party under the Contracts (Rights of Third Parties) Act 1999.

GOVERNING LAW AND JURISDICTION

10.1 These Participation Terms are governed and construed in accordance with the laws of England and Wales.

10.2 In booking to attend an Event you agree that the courts of England and Wales will have exclusive jurisdiction in relation to any dispute arising in relation to the Event and your attendance at it.
